All recognised Charities (including churches) will have Trustees. They are Senior Officers and Trustees of a Charity who have individual, personal duties and responsibilities for the management and administration of that Charity or Association.

 

Many people working within these areas are unaware of the potential of many liabilities. Even though many people give their time 'free' to the Charity where they have an unlimited joint and several responsibility. The important issue for Charities or Associations to consider is the potential liabilities and exposure they open their Trustees, Directors and Officer to, and itself becomes a 'duty of care', particularly to employees of that Charity or Association.

 

The best way to protect the Trustees, Directors and Officers is to take out an insurance policy. However, your Charity's governing deeds/documents need to include a power to obtain Trustees' indemnity/insurance. If the power is not included you will need to obtain an amendment to allow you to purchase insurance. Providing the Charity purchasing insurance cover can show this is in it's best interests, funds can be used and Charities Commission would rarely have an objection.
